- To register a trademark, it must be distinctive in terms of names, letters, numbers, shapes, colors, or any combination thereof, and must be perceivable through sight, meaning that the trademark should be presented in a way that ensures it distinguishes the owner’s goods from those of others.
- Anyone who wishes to independently use a trademark to distinguish goods that are produced, manufactured, selected, or certified by them, or goods that they trade or intend to trade, can request the registration of that trademark in accordance with the provisions of the Jordanian Trademark Law.
- When a trademark registration application is submitted, it is examined to ensure it complies with the applicable laws and that there are no prior registration requests or previously registered trademarks identical to the one being applied for. When the trademark registration request is accepted, whether unconditionally or subject to certain conditions and limitations, the trademark registrar publishes the approved trademark image in the official gazette.
- Any person may file an objection with the registrar against the registration of any trademark within three months from the date of the announcement of the application for registration, or within any other period designated for this purpose.
- If the trademark registration request is accepted and no objection has been filed, or the objection period has expired, or if an objection has been filed and the decision is to reject it, the registrar will register the trademark upon payment of the required fee. The trademark is registered on the application date, which will be considered the registration date. Upon registration, the registrar issues a certificate of registration to the applicant.
- The term of ownership of trademark rights, according to the Jordanian Trademark Law, is ten years from the date of registration, and it may be renewed for similar periods upon the request of the owner. If the trademark owner does not request renewal, it is automatically considered removed from the registry one year after the expiration of its registration term, and others may request to register the trademark in their name after another year.
- The Jordanian Trademark Law allows any interested person to request the registrar to cancel the registration of any trademark that has not been used continuously for three years prior to the request.
- According to the Jordanian Trademark Law, a trademark registration application cannot include multiple classes of goods in a single application. A separate application must be filed for each class of goods.
- The Jordanian Trademark Law allows the transfer of trademark ownership, its assignment, or its encumbrance without transferring the ownership of the business using the trademark to distinguish its goods, or the assignment or encumbrance of the business. It also allows the trademark to be seized separately from the business. The trademark owner can license one or more persons, through a written contract, to use the trademark for any of their goods. The trademark owner has the right to continue using the trademark unless otherwise agreed.
- If the trademark is well-known, even if not registered, its owner may request from the competent court to prevent others from using it on similar or dissimilar products or services, as stipulated by the Jordanian Trademark Law.
- The Jordanian Trademark Law provides protection for trademarks registered outside Jordan if Jordan is a party to a bilateral international agreement or a member of an international treaty that grants mutual protection for trademarks registered with any of its parties. In such cases, any person from a state party to the agreement or treaty may submit a request to the registrar to protect their trademark, and they will have priority over others who apply to register the same trademark in Jordan, provided they file their request with the registrar within six months from the date of submitting the registration request in their home country.
